In February 2025, President Trump issued Executive Order 14202, which created an “Anti-Christian Bias” Task Force to investigate the ostensible persecution of Christians by the Biden administration. The executive order was filled with disinformation about purported anti-Christian bias. In response to Trump’s “Anti-Christian Bias” mandate, the Department of Health and Human Services sent an “Anti-Religious Bias Survey” to all its employees.
Americans United submitted a FOIA request to HHS in December 2025, seeking a copy of the survey and all survey results received. We also sought all reports within HHS of anti-Christian or anti-religious bias dating back to Jan. 1, 2017. When HHS failed to respond and produce the relevant documents within the statutory deadline, Americans United filed a lawsuit under the Freedom of Information Act (FOIA) to compel production of these important records. These records will enable Americans United and the public to evaluate HHS’s commitment to religious neutrality and the Trump administration’s farcical claims that agencies like HHS engage in anti-Christian discrimination.
This is AU’s third lawsuit against the Trump administration for violating federal law by refusing to fulfill our public-records requests for information on how departments are responding to President Donald Trump’s mandate to investigate alleged anti-Christian bias. AU filed similar lawsuits against the Department of Veterans Affairs and Department of State last year; those cases are still pending.
