An independent judiciary is a crucial safeguard of America’s democracy. Courts are an important part of the checks and balances mandated by the Constitution. Occasionally, efforts are made by Congress to remove the ability of the courts to hear certain types of cases, often church-state controversies. Such proposals are not only of dubious constitutionality, they are an assault on basic principles of government. Americans United strongly opposes these “court stripping” measures.
